TERMS AND CONDITIONS
General Terms
By paying your deposit, you agree to the following terms and conditions:
The tour price includes the details of the tour outlined on the information sheet. Some of the details may be changed, but they will be substituted with an item of similar value.
The tour price does not include anything that is not outlined on the information sheet.
The deposit amount is included in the information sheet. Your place on the trip is not reserved until your deposit has been paid, and you have received confirmation from Aspiring Travel LLC*.
Final payment is due 45 days before the beginning of the trip. Failure to pay by this time might result in the cancellation of your reservation.
Any payment, including the deposit, partial payments, and final payment are non-refundable.
If you cancel, then you will not be refunded any monies already paid.
To assure fairness to all participants, no exceptions can be made for any reason, including illness, inability to travel, State Department warnings, or fear of terrorism. All cancellations must be in writing. For your protection, we strongly recommend that you purchase trip cancellation insurance.
Responsibility/Liabilities: We act only in the capacity of agent for the suppliers of the travel services named in the Itinerary or otherwise providing services or goods in connection with the tour (the “Suppliers”), such as airlines, hotels, sight seeing tour operators, bus lines, car rental companies, and providers of entertainment. We assume no responsibility for any personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be occasioned either by reason (1) any act or omission of any of the Suppliers (2) any matter beyond our exclusive control including but not limited to a delay or cancellation of a flight that causes you to miss any portion of the Tour. We have no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. For information concerning possible dangers at destinations, we recommend contacting the Travel Warnings Section of the U.S. State Department at www.travel.state.gov, and click on “Travel Warnings.” For medical information, we recommend contacting the Centers for Disease Control at www.cdc.gov/travel. You assume full and complete responsibility for checking and verifying all passport and visa requirements of the destinations and for complying with all laws of the country in the Itinerary. You are also responsible for respecting the authority and following the directions of the tour guide during a Tour. We may exclude you from participating in all or any part of the tour if, in our sole discretion, your condition or behavior renders you unfit for the tour or unfit for continuation once the tour has begun. Unfitness may include, without limitation, any behavior that, regardless of its cause, is inappropriate or offensive or interferes with the delivery of tour services, or may constitute a hazard or embarrassment. In such case, our liability shall be strictly limited to a refund of the recoverable cost of any unused portion of the tour. We are not responsible for the behavior of other tour participants toward you. Should you decide not to participate in certain parts of the tour, no refunds will be made for those unused parts. You must be 18 or over to participate in the tour without a parent or guardian. You agree to release us from liability for any matter for which we disclaim liability under this Agreement. You agree to indemnify and hold us harmless from and against our liability to third parties arising out of your or your companions’ actions or omissions. If you are under 18, you must be accompanied by a parent or guardian to participate in the tour. If you are a parent or guardian with someone under the age of 18 on the tour, then you take full responsibility for them, and you agree to release us from liability for any matter for which we disclaim liability under this Agreement. You agree to indemnify and hold us harmless from and against our liability to third parties arising out of your or your companions’ actions or omissions.
Any dispute related to the tour shall be governed by Texas law without regard to conflict of laws principles. The federal or state courts in Texas shall be the exclusive forum for any lawsuit related to the tour, and you consent to the personal jurisdiction by said courts. You agree to present any claims against us within 30 days after the tour ends and to file within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You agree to grant us (and third parties with whom we may engage in joint marketing) a worldwide, royalty-free, fully paid up license to use your photographic, video, or digital likeness solely for our promotional and/or commercial purposes. Facsimile transmission of any signed document shall be deemed delivery of an original. At our request, you shall promptly provide an original document as well. If there are any conflicts between this Participant Agreement, the Information Sheet, and the Itinerary, this Participant Agreement shall apply.
Terms of Booking
After receiving the deposit and/or balance payment, we will send you an email, which also acts as your receipt.
If you cancel the activities booked, you will lose some or all of the money you have paid for them.
- The deposit assures your spot on the tour. All payments are non-transferable and non-refundable under any and all circumstances.
Aspiring Travel LLC, or any of its affiliated staff, sales representatives, agents, or persons acting on their behalf, shall not be or become liable or responsible for any loss, injury, or damage to person or property in connection with the program, or any means of transportation or other services connected therewith and whether resulting directly or indirectly from acts of God, dangers, incident by the sea or air, fire, breakdown in any type of equipment, strikes, riots, war, theft, pilferage, quarantine, travel restrictions due to Covid or from any other cause.
Aspiring Travel LLC reserves the right to accept or decline or retain any person as a tour participant whether before or during the program.
Any expenses incurred by delays or events beyond Aspiring Travel LLC's control shall be borne by the participant. (This includes acts of God, dangers, incidents by the sea or air, fire, breakdown in any type of equipment, strikes, riots, war, theft, pilferage, quarantine, or from any other cause.)
Our company does not provide you with travel insurance. We therefore strongly advise you to have sufficient insurance to cover such things as personal accidents, medical treatment, repatriation, cancellation charges, theft, and property loss. If you are not able to get insurance because of age, medical condition, previous fraud, etc., you can sign a disclaimer on the first day of the activities.
